So that we can provide you with your experience we require that you agree to a set of terms and conditions below. Please read these carefully as they form part of an agreement between yourself and App Development Geelong Pty Ltd.

TERMS & CONDITIONS
- Definition
App Development Geelong Pty Ltd (herein referred to as "ADG", "we", "us", "our") is a provider of a form of recreational entertainment service called an escape experience ("the Experience"). The Experience includes but is not limited to any and all activity associated with the provision of the Experience as well as the building which hosts the experience and any and all contents within whether directly or indirectly related to the experience. - You accept these Terms and Conditions
By booking your Experience with us you accept our terms and conditions. - Age Requirement
You confirm that you are 18 years of age. - Booking for Another Person
You agree that you are authorised to make this booking on the behalf of all others attending your booking and that all others attending authorise you and agree to be bound by these same terms and conditions. - Right of Refusal of Entry
You agree that if you are reasonably suspected to be under the influence of alcohol or drugs or present a danger to the property or persons present you will be refused entry.
You also agree that the entire property is non-smoking and that if you are found to be smoking on the property you will be refused entry. - Safety
You agree to follow safety directions from the operator (including signs) at all times. You understand failure to follow any direction given may result in the immediate termination of the experience. - Use of Surveillance
You consent to the use of surveillance for the provision of any assistance, safety instructions and in any claim for damages caused to property or persons. - Non-Physical Gameplay
You understand that the Experience does not involve the use of any physical abilities such as running, jumping, climbing, crawling and the like. You understand the Experience is a test of problem solving ability designed to challenge your intuition and intellect. You accept that deliberate, reckless or inappropriate use of force may result in the termination of the Experience without refund and will make you liable for any damage or harm to persons or property caused as a result. - Liability to ADG
You agree to be liable to ADG for any damage or loss caused by you in your participation in the Experience where such loss or damage is the result of actions not reasonably within the scope of normal participation. - Our liability to you
Our liability to you is restricted by a liability waiver. As part of our terms and conditions your entry is conditional upon you signing our liability waiver. Should you decide to not sign the liability waiver - a copy of which is at the end of this document - you accept that you will be refused entry. - Liability to fellow participants
You accept that ADG is not liable for loss, damage or harm caused by you to another person or person's property. - Liability to the general public
You accept that ADG is not liable for loss, damage or harm caused by you to the general public or general public's property. - Liability to the City of Greater Geelong
You accept that ADG is not liable for loss, damage or harm caused by you to the City of Greater Geelong, it's staff, sub-contractors or agents or loss, damage or harm caused by you to the City of Greater Geelong's property. - Medical Treatment
You agree to pay the costs and authorise ADG to take steps considered reasonably necessary to protect your welfare in the event of personal injury including ambulance transportation and/or the administration of medical treatment. - Health Conditions
You agree to disclose any serious medical conditions (such as severe asthma, heart condition or allergies) to ADG prior to participation. ADG reserves the right to refuse entry or modify the experience if it believes on reasonable grounds that the experience presents a risk to your health. - Vouchers
You agree that:
Vouchers are sold as an Experience based on the number of persons to be admitted and do not have a prescribed dollar value;
Vouchers are valid for three years from the date of purchase;
Vouchers for more than two people cannot be reimbursed for their remaining value should fewer people attend;
Vouchers cannot be cancelled or redeemed for cash or credit;
Voucher bookings cancelled with 48 hours notice or more are to be refunded by re-activating the original voucher unless expired;
Voucher bookings cancelled within 48 hours of commencement will not be reactivated or refunded. - Refunds
You agree that:
Bookings cancelled with at least seven days notice will not receive a refund;
A booking is deemed to be cancelled if:
- No-one shows up; or
- No-one arrives 15 minutes or more after the starting time; or
- The Group is refused participation (eg Prior consumption of Alcohol); or - Refunds for persons who did not make it or who arrived 15 minutes or more after the starting time
You agree that there are no refunds for persons unable to attend. - Changes to Time of Booking
You agree that bookings cannot be transferred to another date or time unless agreed to in writing by ADG and with 48 hours notice or more. - Changes to People Attending
You agree that:
The original person who made the booking cannot transfer their booking however other persons attending can be changed.
Changes do not need to be announced.
You agree that you are authorised to make these changes on the behalf of new and prior attendees as their authorised agent and as such the new attendees shall be bound by these same terms. - Adding or reducing the number of people attending
You agree that:
Bookings cannot be altered to add or remove the number of persons attending without at least 48 hours notice; and
Only where confirmed in writing by ADG; and
The difference (if any) has been paid (as below) by the person who made the original booking; - Items not permitted in the room
You agree that no food or drink or dangerous items (such as sharp objects or lighters) are permitted within the room. - Use of Mobile Phones
You agree to not use a mobile phone whilst engaged in the experience. Persons wishing to use mobile phones may remove themselves from the experience to do so. - Photos and Recordings
You accept and agree to not make any video, photo or other recordings of any part of the experience and understand that videos, photos and/or recordings are strictly prohibited. - Promotional Photos
Should you agree to having your photo taken you give your consent to ADG to use these photos for promotional purposes (including distribution across social media). - Sharing details from the experience
ADG provides this experience in confidence so as to preserve the experience for others. Details about the experience (such as game play, props, room design and puzzle solutions) are confidential and are not to be disclosed in writing (including on Facebook or TripAdvisor), nor relayed orally or represented visually. You agree to be bound and keep confidential all details about the Experience. - Use of ADG photos, graphics, videos, music or literature without consent
Photos, videos, artistic drawings and graphics, writing (including story plots) and music found online (including our website and social media forums) and are all works belonging to ADG and are all protected by copyright. You agree to not reproduce or redistribute these works without express written consent from ADG. - Blog, Editorials, News Article, Radio and other Media publishers
You agree not to use, mention or reference the experience in any editorial, article, blog, radio segment or other publication and that this applies to yourself and all persons with whom you have contact with and who are connected with publications (blog, posts, radio, tv, editorials and other media). - Jurisdiction
You agree that this booking is made in Victoria and is to be subject to the jurisdiction of the Supreme Court of Victoria. This agreement is intended to act both jointly and severally and should any part of this agreement be invalid or unenforceable all other parts are still to be given their full effect.
